TERMS OF REFERENCE
 

PAKISTAN NAVY BENEVOLENT ASSOCIATION

PERSONNEL, PAY, SERVICES, DISCIPLINE, LEGAL, FINANCE, ETC

INTRODUCTION               

1.         The Pakistan Navy Benevolent Association (Short Title PNBA) is a welfare organization of Pakistan Navy registered with the Government of Sindh under the Charitable Endowment Act XXI of 1860.  Affairs of PNBA are run by its Secretary and his staff. All correspondence  is to be addressed to Secy PNBA at the address given below:

2.          PNBA has its camp office at Karachi to ensure recovery of loan through CNA and apprise PN personnel regarding PNBA welfare scheme. The address is as under:

3.         Secretary PNBA is responsible for smooth maintenance and operation of all accounts of PNBA. 

HISTORY OF PNBA

4.         The Association started functioning in 1947 after establishment of Pakistan. PNBA has invested its funds in different project. PNBA has intention to invest its funds in such joint ventures in future.

WELFARE ACTIVITIES

5.         Under mentioned are the salient welfare activities in which PNBA provides financial assistance:

a.         Financial support to PNET schools situated in Sailors’ Residential Estates, Bahria Colleges and Special Children Schools at Karachi and Islamabad.

b.         Financial assistance on regular monthly basis to deserving retired PN personnel / families of retired PN personnel.

c.         Financial assistance to the NOK of PN serving personnel who die during active service till such time that their family/dependent pension is sanctioned by the Government (MMA TFP).

d.         Hiring of CMPs for different medical centres through DGMS (N).   

e.         Annual allocation of funds to Admin Authorities to meet welfare needs of their commands.

DETAILS OF PNBA WELFARE ACTIVITIES

6.         Details of PNBA welfare activities are as under:  

a.         PNBA Loan/Grants  It is an interest free loan recoverable in 30 equal installments.  Funds are allocated to Admin Authorities to sanction loan/grants for any lawful purpose irrespective of length of service.  PN personnel may apply for this loan at any time during the financial year.  Admin Authorities are empowered to sanction loan/grant.  Admin Authorities are also empowered to delegate the financial powers to the Type Commanders/Commandants and Commanding Officers in accordance with their ranks under their command. 

b.         General Purpose Interest Free Loan    It is an interest free loan recoverable in 100 equal installments.  Funds are allocated to Admin Authorities in accordance with the proportional borne entitled strength.  The loan applications are recommended and forwarded to NHQ for approval of DCNS (Trg&P) on the basis of criteria promulgated through a policy letter. 

c.         NHS Loan    PNBA provides NHS loan to PN retiring officers for the first payment of DNHS schedule. 

d.         Funeral Grant         

(1).      Funeral grant @ Rs 20,000/- is admissible in case of death of serving PN personnel and their dependents, where dead body is transported from duty station to native town. 

(2).      Funeral grant of Rs 15,000/- is admissible in case of death of serving PN personnel and their dependents, where dead body is not transported from duty station to native town. 

e.         Monthly Maintenance Allowance Till Finalization of Pension (MMA TFP)  As an interim relief in case of death of serving personnel, the next of kins of the deceased are granted Monthly Maintenance Allowance equal to approximate pension.  This grant is continued till pension is finalized.  

f.          Marriage Grants PNBA provides following financial assistance for marriage of two daughters of a deceased officer on case to case basis.

g.         Reimbursement Scheme for the Cost of Surgical Appliances PNBA provides facility of reimbursement of cost of surgical appliances, which the service personnel expend for their dependants. The facility was introduced in Jan 2003 and has proved to be moral boosting and a great relief to PN personnel.

 h.         General Group Insurance (GGI)   

(1).      PNBA is providing insurance coverage to all serving and retired PN personnel (except those personnel on secondment with PN). 

(2).      All serving PN personnel and those retired w.e.f. 01 Jan 04 are covered under the revised GGI scheme till the age of 65 years or 15 years after retirement whichever is earlier. However personnel who retired before 01st Jan 04 are covered under the old GGI scheme till the age of 60 years or 10 years after retirement whichever is earlier. 

 (3).      Retired PN personnel are not required to pay any premium. 

k.   Additional Group Insurance (AGI).  AGI scheme is specific for serving PN   personnel only including recalled/re-employed.  The scheme is 100% funded by PNBA and the members do not contribute for any premium.  

The payment of AGI is to be released after approval by Competent Authority. 

AIM AND OBJECTIVES OF PNBA

7.         Aim and Objectives of the Association are as follow:

a.         To render charitable help and to relieve hardships or distressed amongst serving and retired PN personnel: 

b          Widows, orphans and other dependents of PN personnel as mentioned in para 6 (a) above. 

c.         To affiliate/amalgamate with and support any other association having similar objectives.

d.         To appeal for and accept gifts or otherwise raise funds consistent with the objectives of the Association whether unconditionally or subject to conditions or trusts.

e.         To purchase, take on lease, hire or otherwise acquire and hold immovable property and to sell / lease or otherwise dispose off the same.  

f.          To invest and deal with the monetary holdings of the Association in such a manner as may from time to time, be determined and vary or realize such investments. 

g.         To borrow/raise any money required for the purpose of the Association and to render monetary help to such persons and to such extent as may seem expedient. 

h.         To erect, maintain, repair or improve any building for the purpose of the Association. 

j.          To maintain homes, hospitals or educational institutions for those entitled to benefit from the fund of the Association. 

k.         To do all such other things as are incidental or conducive to the attainment of the above objectives with the approval of Competent Financial Authority.

8.         Definitions.  Unless there is anything repugnant in the subject or context:

a.         ‘Fund’ shall mean the Benevolent Association Fund. 

b.         ‘Subscriber’ shall mean a PN serving Officer, Chief Petty Officer or Sailor who subscribes regularly to the fund. 

c.         ‘Family’ shall mean in case of male employee, the wife or wives, and in case of a female employee, the husband of the employee, and the legitimate children, parents, minor brothers, unmarried/divorced or widowed sisters of the employee wholly dependent upon him/her or determined by the court in accordance with Law of Inheritance.  

d.         The ‘General Body’ shall mean subscribers or their representatives.

 e.         The ‘Governing Body’ shall mean the Governing Body of the Association.

 f.          The ‘Committee’ shall mean the Relief and Finance Committee of the Association. 

g.         The Management Committee NPFMC shall mean the Naval Prize Fund Management Committee of the Association. 

9.         Subscription.   

a.         The General Body is competent to increase or decrease the rates of subscription towards PNBA by a majority vote provided the quorum is complete.   

b.         Donation by any body would also be welcomed and duly acknowledged by the Secretary PNBA in the form of an official receipt.   

c.         Subscription to the Association shall be compulsory for all serving PN personnel and would be recovered from the individual’s pay by the Controller of Naval Accounts under the authority of NR 1438(I)(e).  The sum of money so collected would be remitted by the CNA to the Secretary PNBA on monthly basis.     

d.         The subscription rates to be revised after every 03 years percentage increase is to be determined in the General Body meeting.

10.         Management and Administration of Main PNBA Fund.  The Main PNBA Fund is managed and administered by the General Body, Governing Body and Relief and Finance Committee, the details of which are given in the ensuing sub-paragraphs.  These three bodies have been formed in accordance with the Memorandum of Association duly registered with the Government of Sindh.  The decisions taken by these bodies and day to day affairs are run by the Secretary PNBA and his staff: 

a.         General Body.  The General Body is the supreme body of PNBA.  Its meeting is held once in a calendar year in Bahria Auditorium Karachi, at a time duly notified by a General Message.  This Body can also be convened to meet by a written requisition addressed to the Secretary PNBA, by not less than 10 members giving at least 14 days notice to meet and specifying the general nature of business to be conducted.  At the General Body meeting the President PNBA is entitled to chair the meeting and all members are also entitled to attend and vote.  All matters are decided by show of hands and each member present has one vote.  In case of equality, the President has a casting vote. 

Powers of General Body.   The General Body is the only authority to alter/make additional rules at any time by a two third majority of members by raising hands.  Generally, following matters fall under the perview of General Body: 

(1).      Enhancement in subscriptions towards PNBA

(2).      Insurance matters

(3).      Enhancement in financial powers of various PNBA forums

(4).      Investments

(5).     Change in composition of PNBA Governing Body and Relief & Finance Committee

(6).       Any other activity / scheme for the welfare of PN personnel 

b.         Governing Body.  The Governing Body is the next tier of management of PNBA after the General Body.  Its meeting is held twice in a year.  It has powers to invest funds, make allocations, approve budget, make or vary rules of business, form sub-committees, delegate authority to one or more of its members for specific purposes, appoint auditors, approve the audited accounts.

c.         Relief and Finance Committee.  This committee considers and deals with applications for loan/grant as welfare measures in accordance with aims and objectives of PNBA.

11.    PNBA Naval Prize Fund Management Committee (NPFMC)

a.         PNBA funds are managed/administered by PNBA NPFMC. 

b.         Its meeting is held twice in a year.  It has power to invest funds, make allocations, approve budget, make or vary rules of business, appoint auditors, approve the audited accounts and approve expenditure/investment.

12.       Budget, Audit, Maintenance and Operation of PNBA Fund 

a.         Budget.  Allocation of funds for various welfare measures out of PNBA Main Fund Account and PNBA Naval Prize Fund Account are required to be submitted by PNBA for consideration and approval of PNBA Governing Body and PNBA Naval Prize Fund Management Committee (NPFMC).  The approved budgets form the basis of expenditure to be incurred during the Financial Year.  The budget presentation should include all financial statements (income & expenditure, balance sheet and fund flow statement).     

b.         Maintenance & Audit.  Secretary PNBA maintains accounts of all transactions of income, expenditures, money, properties, securities etc belonging to PNBA.  Assistant Secretary PNBA is to assist the Secy PNBA regarding maintenance of accounts as per NR. The accounts are audited annually by a firm of Chartered Accountants duly appointed by PNBA Governing Body.

 c.         Operations.  PNBA funds are operated jointly by DGWR and Secy PNBA.  All cheques and transactions of PNBA with banks and individuals are to be under taken through crossed cheques duly endorsed with joint signatures of the above two operators as co-signatories after approval of Competent Authority.  Assistant Secretary is to initiate/manage and administer the financial matters in all respect.
